New Laws for New York State Employers

MINIMUM WAGE ACT (GENERAL EMPLOYMENT)

The General Industry Minimum Wage Act states that all employees in New York State, including most domestic workers, must be paid at least $7.15 per hour beginning January 1, 2007.

The basic rate may be modified by certain requirements set under regulations known as  "wage orders." These provisions of the minimum wage law cover jobs in the restaurant, hotel, and building service industry, and miscellaneous industries and occupations.  They set an hourly rate plus overtime and allowances in four General Industry Wage Orders, based on meals and lodging supplied by an employer.

Some industries make allowances for tips, thus they set a lower hourly rate. For example, food service workers may earn $4.60 per hour because their total compensation includes expected tips. When required uniforms are maintained by the worker, certain allowances also apply. Other service workers have a minimum rate of $5.40 per hour.  There are also allowances for meals and lodging supplied by an employer.

New York is still an employment at will state


New York State is an "employment-at-will," state. Without a contract restricting termination (such as a collective bargaining agreement) an employer has the right to discharge an employee at any time for any reason. This also protects the employee's right to resign. An employer may fire an employee for "no reason" - or even for a reason that might seem arbitrary and unfair

MINIMUM AGE FOR EMPLOYMENT

There are certain exceptions to these rules and they are subject to the employment certification regulations that follow:

 

Minimum age for employment

Minors not yet 14 may not be employed at any time, neither after school nor during vacation

Minors 14 and 15 years old may work after school hours and during vacations, but not in factory work. They may do delivery and clerical work in any enclosed office of a factory, and in dry cleaning, tailor, shoe repair, and similar service stores.

Minors 16 and 17 years of age, if not attending school, may work full time throughout the year. Factory work is permitted for minors 16 years of age or older.

EXCEPTIONS - MINIMUM AGE FOR EMPLOYMENT

Minors 12 years of age or older may be employed in the hand harvest of berries, fruits, and vegetables.

Minors 11 years of age or older may work outside school hours as newspaper carriers to deliver, or sell and deliver newspapers, shopping papers, or periodicals to homes or business places. Minors 14 years of age and older may be engaged in street trades work, i.e. selling newspapers or periodicals on streets or public places.*
*(Under Federal law a 14 year age minimum is required for delivery of periodicals and similar items.)

Minors 12 years of age or older may work outside school hours for their parents or guardians either on the home farm or at other outdoor work not connected with a business.

There is no minimum age for child performers at theatrical, radio, or television performances or for child models.

BEING A BOSS

When I was a child I used to say "Why can't bosses just be nice"  As a child our parents and schools taught us to be nice.

It is important for a leader to remain emotionally distant from his subjects.

Kindness might be a sign of insecurity or weakness.  Kindness can be a subconscious or conscious clue to others who has more power.

 

When a person goes on a job interview for a position that is very difficult to attain and that would change their life in a very positive direction, a job that has many applicants and few positions how are they going to behave on the job interview?

How does the boss who interviews all of these candidates for this job behave?

Most potential employees will act kind and nice even if they do not like the boss who is interviewing them.  Most bosses while being polite in such a situation will not behave overly friendly especially if the candidate is not going to be chosen or is not qualified

If a beautiful woman is approached by an unattractive stranger that wants a date with her, how is she going to behave

Once again in the majority of situation the person that wants something from the other party is going to be kind and nice.  The party that is less interested is going to be more distant and arrogant.  When you have something everyone wants, they have to be nice to you in order for you to give it too them.  You have the power, you make the rules, you are the boss.  When you need a favor from someone else and you have to beg, plead and make promises to them in order for you to get what you want , they are in control and they are the boss. 

The point I am illustrating is that kindness in the form of being too friendly to nice are interpreted as weakness and give incorrect signals to job candidates and employees.  You are telling them that they have the power.  If they believe that they have the power they are more likely to resist your rules and demands.  An employee might view the employer as weak and not going to fire or discipline him. 

The employer has invested time effort and money in training the employee.  The employer loses money, takes on stress and other negative effects when forced to terminate or discipline and employee.  However the employee who believes that they can get away with something or push and demand from the employer will force the employer to action.  Action is expensive.  Further if one employee misbehaves and doesn't follow the rules it will spread like a cancer through the organization.  Employees will say why do I have to follow the rules if "he " doesn't have to follow them.

Therefore do no be overly kind or nice.  Do not be too personal.  Do not be a friend to your employees.  Do not show them weakness.  Always be aware of the power dynamics of the relationship. BE A BOSS

 


 

If an employee can sue an employer, don't you think an employer should be able to sue an employee?
 Yes, Absolutely
 No, the government should continue to promote laziness and incompetence in the workforce
